Termd and conditions
These general conditions of sale govern the terms and conditions of sale of products marketed by pimarstore.com.
All contracts for the sale of products by pimarstore.com to third parties (the “Customer”) are governed by these Terms and Conditions, which form an integral and essential part of any proposal, order and order confirmation of purchase of the Products themselves.
The conditions of sale apply to your order are those in effect on the date of the order.
1. Products: prices and features
1.1 Unless otherwise indicated, the prices of the products published by pimarstore.com are inclusive of VAT. The prices of products from time to time published by pimarstore.com cancel and replace the previous ones and are dependent on the availability of products. pimarstore.com reserves the right to confirm or modify the prices of products posted on its website or in brochures and advertising material at the time of confirmation of the customer.
1.2 The technical and functional relating to products published by pimarstore.com through its promotional messages and information leaflets are those submitted by their respective manufacturers. pimarstore.com assumes no responsibility regarding the accuracy and completeness of such information. Product images are indicative and not binding.
1.3 The Products are not provided in evidence. Customer is responsible for choosing the products ordered and the compliance and conformity with the specifications set by each manufacturer for your needs.
2. Orders – Billing
2.1 All purchase orders for products sent to pimarstore.com will be complete in their entirety and must contain all the elements necessary for the proper identification of products ordered. Each order for products sent to pimarstore.com constitutes Customer’s contract proposal and, therefore, will be binding only if pimarstore.com confirmed for the same acceptance. The order by pimarstore.com, equivalent to confirmation and acceptance thereof.
2.2 pimarstore.com reserves the right not to accept orders incomplete, not properly completed.
In case of failure to execute the order by pimarstore.com (if the same is due to unavailability of products ordered by the customer) pimarstore.com will soon inform the Client, refund amounts, if one has already paid for the provision has not performed. In this case the customer is not entitled to any reimbursement or indemnity or compensation.
2.3 The tax records relating to the Products ordered will be issued by pimarstore.com upon shipment of Products to Customer. The customer will have to fill in the field TAX ID or VAT (if it holds) and will receive the invoice with the goods.
3. Delivery of Products
3.1 All costs of delivering the products are to load of the customer. Deliveries are normally made by courier
pimarstore.com has the right, in its sole discretion, to make delivery of products ordered by a carrier other than indicated or by other means it deems appropriate.
3.2 The delivery times indicated by pimarstore.com refer to these products at its stores and, despite being carefully evaluated, are not binding for pimarstore.com, which can then confirm or change, depending on your actual needs. Any delay in delivery of less than 30 (thirty) days shall not entitle the customer to refuse delivery of the Products, or to claim damages or compensation whatsoever.
3.3 pimarstore.com has the right to make delivery of Products (even on the same order) in several successive deliveries without prejudice, in this case, one charged to the customer by way of transport costs.
3.4 The customer is obligated, upon receipt of the goods, to check the consistency of the same quantity and to verify the outer packaging and to notify immediately to the carrier any defect or deformity giving, at the same time, immediate notice to pimarstore.com.
3.5 Conditions and terms of delivery details will be agreed between the customer and pimarstore.com and accepted in writing by pimarstore.com.
4 Modes of Payment
4.1 Purchases made on site www.pimarstore.com can be performed in the following manner:
• PAYPAL
• CREDIT CARD
• BANK TRANSFER through the appropriate section present during the purchase of products
5 Product guarantees – Technical assistance
5.1 All products purchased on pimarstore.com are covered by the legal guarantee of 24 months from the seller provided by the Consumer Code (Legislative Decree no. 206 of 6 September 2005)
5.2 The product warranty may be enforced only upon presentation of documentation deemed necessary by pimarstore.com.
5.3 pimarstore.com guarantees only the material integrity of the products upon delivery. Any defects covered by warranty pimarstore.com must be reported by the customer, subject to revocation, no later than 10 (ten) days from the date of delivery. In case of operation of the guarantee of pimarstore.com, Customer will be entitled to the replacement of products damaged upon return of the same, having no right of the Customer to compensation for any further damage. The postage required for the replacement of Products shall be borne by pimarstore.com.
5.4 Notwithstanding the provisions of article 5.1, pimarstore.com not pay any guarantee on products additional to that provided by individual producers. Technical assistance and warranty work on products are made, where applicable, by individual producers, according to the terms and conditions reported in the literature accompanying the Products. In particular, pimarstore.com not give any guarantee about the compatibility of products with other products or equipment used by the customer, nor give any guarantee regarding the suitability of products for specific use intended by the customer.
5.5 Without prejudice to the case of fraud or gross negligence of pimarstore.com, is now agreed that, if found responsible for pimarstore.com in any capacity against the Customer – including the case of default, in whole or part, the obligations assumed by pimarstore.com to the Customer as a result of the execution of an order – the responsibility of pimarstore.com not exceed the price of products purchased by the customer and for which the dispute arose.
6. Return Policy
6.1 Under Article. 5 of Legislative Decree 22 May 1999 n. 185, the customer (if it qualifies as a “consumer” within the meaning of article 1 letter b) of Legislative Decree 22 May 1999 n. 185) has the right to cancel the contract and return the products ordered, without penalty and without giving any reason, within 10 (ten) business days from receipt of the Products.
6.3 All returns (which must be undamaged and accompanied by original packaging) must be authorized by pimarstore.com Then the customer can return the product to the following address: Parafarmacia Treasury, Piazza Del Popolo 8 74020 Maruggio.
6.4 Upon receipt of the Products (and verified their integrity) pimarstore.com will, as soon as possible we will credit the customer the cost of returned products (as indicated on the invoice), deducting the amount of postage that will remain definitively borne by the customer.
7. Jurisdiction
Subject to any applicable mandatory provisions of law for the protection of consumers (as defined under article 1 letter b) of Legislative Decree 22 May 1999 n. 185), any dispute related to these Terms and Conditions, shall be under the exclusive jurisdiction of the Court of Lecce.
Pursuant to and for the purposes set out in Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and to accept specifically the following clauses of the General Conditions of Sale pimarstore.com: 1.1, 1.2, 2.1, 2.2, 3.2 , 4.1, 5.1, 6.1, 6.2, 7.
